Apple And Samsung Return To Court For The Second Time Over Longstanding Patent Dispute

Apple and Samsung have been going at each other over the alleged misuse of Apple’s patents by Samsung. Two years ago, the US court granted Apple victory but now both the companies are back again in court arguing over a fresh round of patents and the phones that Samsung has sold in the mean time. Here’s is the look at the stands that both companies are taking for this legal battle. 1. Apple: Apple believes that it changed the consumer mobile landscape single handedly by coming up and perfecting the iPhone. The company is letting the court know that it was a difficult thing to break into a market with a revolutionary product and it did face some major risks while doing that. It argues that after its success with the iPhone, Samsung merely copied the successful aspects of the iPhone to coast along and make a huge amount of sales. Samsung grew over these years to become the largest phone manufacturer in the world. According to Apple, Samsung’s copying was expansive and they did take a lot of inspiration from the iPhone. The company estimates that it infringed on as much as 50 patents but it is not reasonable to fight legally with the Samsung based on that number. Instead, it is choosing to contend over 5 major patents for which Apple wants $2 billion in damages for the violations and the 37 million phones that Samsung has managed to sell since 2011. 2. Samsung: Samsung on the other hand is claiming that it did not infringe on these patents. It is making a narrative to show that Apple is making a case based on rivalry. For example, Steve Jobs was thoroughly angry with the emergence of Android and wanted to go against it all costs. However, at the same time Android was getting successful because of its open nature. Steve Jobs and Apple perceived Android as a direct threat and wanted to put it down. Samsung feels that this alleged patent infringement is coming from this and not actual copying of features. Samsung also had a successful marketing run where it poked fun of Apple and its products, which apparently drove tempers high at Apple. Samsung has also strategically passed the buck onto Google. Even though Google and Android are not being explicitly mentioned in this lawsuit, Samsung is making the case that Apple is going after Samsung, to indirectly take on Google and Android. Samsung is also keen on showing that the similarities between its smartphones and those of Apple’s diverged significantly over the years to become completely different types of products. Both parties currently have some valid points and it is still not clear about which narrative will the California court favor.
